Madison Immigration Law specializes in the variety of options for immigration or permanent residence in the United States including:
H-1B visas are available only to workers in occupations requiring highly specialized knowledge normally acquired through a college education. To qualify for this visa, a person needs at least a bachelor’s degree and substantial on-the-job experience that is the equivalent of a bachelor’s degree. A person must be coming to the U.S. to perform services in a “specialty occupation.” The person must have a job offer from a qualified U.S. employer for work to be performed in the U.S., and the offer must be at the prevailing wage that is paid the same geographic area foro that type of job. The employer must have filed an attestation with the Department of Labor.
A person may qualify for an L-1 visa if that person has been employed outside the U.S. as a manager, executive or person with specialized knowledge for at least one out of the past three years, and that person is transferred to the U.S. to be employed in a position that utilizes that person’s special knowledge and skills. The U.S. company to which that person is transferring must be a branch, subsidiary, affiliate or joint venture partner of your the non-U.S. employer.

2nd Preference (EB2)
The second preference (EB2) is comprised of workers 1) who are members of the professions holding advanced degrees or their equivalent, and 2) who because of their exceptional ability in the sciences, arts or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States. Labor certification is required.
O-1 visas apply to a person of proven extraordinary ability in the sciences, arts, education, business or athletics. To be considered a person of extraordinary ability, that person must have sustained national or international acclaim. Person working in the motion pictures or television productions must demonstrate a record of extraordinary achievement.
Naturalization and citizenship
To qualify for citizenship, a person must have held the permanent resident status (green card) and been physically present in the U.S. for a certain period of time (typically 5 years, or if you are married to a U.S. citizen for at least 3 years). Further, the person must be a person of good moral character and have knowledge of the English language and be familiar with American government and history. Further, The person must be willing to take an oath of allegiance to the United States.
PERM/Labor Certifications
Program Electronic Review Management system (PERM) arrived in March 2005. PERM system has generally been faster in obtaining labor certification approval with the Department of Labor (DOL).
National Interest Waivers
The National Interest Waivers (NIW) is a waiver of the job offer requirement for individuals who wish to immigrate to the U.S. in the second preference category who are members of the professions holding advanced degrees or individuals of exceptional ability in the arts, sciences, or business. The waiver requires a significant showing that this waiver is for the prospective national benefit.
Extraordinary Ability Applications
